Part III: Draft Immigration Reform Points

I was taught that in a discussion of a problem a person should follow up with suggestions for solving that problem. In the last two parts of this series [Part I: The Silent Majority Wants Immigration Reform and Part II: Let's Formulate A Plan (For Immigration Reform)] we discussed the problem and I requested suggestions for some solutions. I now submit for your review and comments a draft plan of points I believe should be included in immigration reform. They are not all inclusive. I attempted to cover the main problem areas that I am aware of in the current law. To reduce the amount of reading I thought about just publishing them over the span of a couple of articles but they are all connected. Then I contemplated giving my rationale of each point but even my eyes started glazing over when that article got too wieldy. So I decided to offer what I have drafted and then in later articles to perhaps discuss the rationale behind them.

  1. Within ten days after the passage of the bill a public announcement will be made via all forms of media stating that illegal immigrants have six months from date of publication to voluntarily leave.
  2. Those that choose to voluntarily leave may register for immigration prior to leaving. This will put them on a priority list for re-immigration providing they meet all legal qualifications of Title 8 USC. Legal immigration will be prioritized by length of time in the US but at no time will exceed normal immigration quotas.
  3. Those eligible may opt to choose military service in lieu of deportation providing they meet all enlistment criteria.
  4. All applicants for immigration must meet the following requirements:

      a. Be of good moral character.

      b. Not previously been ordered to leave the US by an Immigration Judge.

      c. No record of being subsidized by public welfare.

      d. No outstanding Court ordered debts (civil or family court).

      e. They should be able to provide a verifiable work record for the period they claim to have been in the US.

      f. Be free of any physical or mental disorder and behavior associated with the disorder that may pose, or has posed, a threat to the property, safety, or welfare of the alien or others.

      g. They must not be a drug abuser or addict (as defined in regulations prescribed by the Secretary of Health and Human Services), nor can they be or have been a drug trafficker.

      h. They must not have committed any acts of terrorism.

      i. They must be prepared to swear an oath of allegiance to the United States of America.

  5. Providing they meet all criteria for naturalization, families with “anchor minors” in public schools maybe granted provisional waivers to remain in the US with temporary green card privileges but must leave the country within six (6) months of the minor child turning 18 years old. After the family has left the country, the natural born Adult (formerly the “anchor child) may file for family immigration in accordance with immigration procedures and quotas.
  6. Those undocumented immigrants who do not choose to leave voluntarily will face forced deportation and will forfeit all rights of legally immigrating in the future.
  7. Those deportees who are relocated forcibly will be fined the transportation costs to their native countries.
  8. Resident Alien Immigration quotas will be established (based on previous years statistics of number of deaths plus number of emigrants minus the number of live births multiplied times 100% plus the average National unemployment percentage).
  9. H1B work visas will be limited to occupations and positions deemed critical need by the Department of Labor. These visas will be subject to annual review. H1B visa holders may apply for permanent resident status after five (5) years of continuous residence without having to return to their country of origin.
  10. H2B work visas will be limited to ten (10) months in any given calendar year. These visa holders will be eligible for a non-resident (international driver's license).
  11. Children born in the US to H1B or H2B visa holders while working in the US will not be eligible for citizenship.
  12. H1B and H2B visa holders will be provided information on their employment rights in accordance with Labor Laws upon entry to the US.
  13. Law Enforcement agencies in the US will be required to validate immigration status of all arrested persons.
  14. Employers must validate all employees’ rights to work and maintain proof of validation. Failure to validate or to maintain validation will result in fines and forfeitures. These fines and forfeitures will increase 150% will each subsequent violation.
  15. Fiancée and Asylum visas will not affect any annual quotas.

I'll have to read this over and over a few times and have a think, but well done indeed for putting the time in to outline a program that you would support.

Civil Truth and Neil...you all read that entire article, and all you could come up with was advice on how to edit the title? Seriously?!

1) Titles of articles have traditionally been in all caps for a very long time. Get used to the fact that some folks who are relatively new to blogging may not intuitively know that this is no longer a common practice in some forums.

2) Anyone who is going around posting comments twice, probably isn't in the best place to be giving unsolicited blogging "help."

Your comments are noted. However please also note that I am part of the team who tries to help keep this site running. Sometimes I will enter a thread purely to comment on how the site is used, rather than the content. This is necessary for me to do what I do for Red State.

And further, no, it is not traditional for titles at Red State to be all-caps. We routinely ask people not to do it when it is done. All-caps text is harder for people to read, is unnecessary, and is mildly disruptive. That's why we ask people not to do it.

And yes, we are used to people not knowing how things work. That's why I nicely asked this poster not to do it anymore.

So I suggest you calm down and take further complaints to the contact form. Thank you.

Thank you for the reply, Neil, and for (finally) introducing yourself properly, before giving further "orders." It was not possible before to distinguish you from a troll. Now, at least, I understand that you're operating in an official capacity with RedState, so I apologize for responding to you as if you were a troll.

I have no idea where the "Contact Form" is, but who has time for that, anyway? There are plenty of other places to go on the web where the discussion is not going be stifled in such a manner.

It's not against the rules. You can't get banned for doing it, really. We just ask people not to do it because it's annoying. ALL-CAPS TEXT IS UNNATURAL AND HARDER TO READ; THAT'S WHY WE USE LOWER-CASE LETTERS TO BEGIN WITH.

We have no formal style manual at Red State. We know that most here aren't pros; a great many of the editors aren't, either. We merely ask people not to do this one thing.

Some undocumented immigrants will accept the voluntary leaving as long as they know they can be fast tracked for legal immigration. Others who are here strictly for the money with no intention of staying will comply due to the changes in the guest worker program. As for this country's ability to deport a large number of individuals it won't happen overnight. This problem has exponentially gotten worse over the last 30 years and will require time. The plan will require the cooperation of Federal, State and Local authorities. When you take away the jobs, the benefits,and the sanctuaries undocumented workers will have no choice. We have the capability of cross-referencing every address in the US to utility bills, Social Security numbers, and other data bases. Anyone staying after the final date would be deported when discovered. Any children born after that date could not be used as "anchors".

The 287(g) programs is working in Davidson County, Tennessee (Nashville). According to an article ( http://www.tennessean.com/apps/pbcs.dll/article?AID=/20080428/NEWS01/804... ) published on April 28, 2008, in the left-wing, pro-illegal alien Tennessean, nearly three thousand (3,000) illegal aliens have been placed into deportation proceeding in Davidson County during the first year of participation by the Metro Nashville Police Department and the Davidson County Sheriff's Department in the 287(g) program. Of course, the Tennessean doesn't like the fact that nearly 3,000 illegal aliens have been placed into deportation proceedings in Nashville. The left-wing Tennessean has editorialized in favor of driver licenses for illegal aliens, as well as legal status and a path to citizenship for illegal aliens.

Thirty-eight percent (38%) of the illegal aliens arrrested had multiple arrrests in their backgrounds.

Here is a very small portion of the rather lengthy Tennessean article:

But for Davidson County Sheriff Daron Hall, a crime is a crime. And an illegal immigrant is an illegal immigrant.

"I think, to me, it's a little irresponsible to wait until someone commits a violent act and then deport them," Hall said. "The person didn't follow immigration laws, driving laws and criminal laws, and that's reason enough to believe they will continue to not follow our laws."

He added that Metro's database goes back only seven years and that serious crimes could have been committed elsewhere.

undocumented immigrants would have the choice of proving their willingness to obey our law. Those failing to voluntarily depart would be deported immediately without hearing. The reforms suggested give them sufficient time to either get their affairs in order or file for the appropriate waivers or to correct erroneous information. They are currently showing their disdain for this Country and its laws. While I am sure the American Communist Lawyers Union will disagree this the problem is already epidemic. The 287(g) programs currently still allow too much lag time and the undocumented aliens either drop back out of sight or try to circumvent the system via fraudlent marriage or by producing "anchor" children prior to appearance before an immigration judge. Those found guilty of criminal offenses (felonies and misdemeanors) should be subject to immediate deportation as they have had their "day in court".

The 287(g) program is just one part of the solution to the illegal alien problem. However, I do believe it can be an important part of the solution.

but it and programs like IMAGE should be mandatory not optional.
